The Noise Factory Booking and Cancellation Policy

1. Introduction
These Terms and Conditions (hereinafter referred to as “Agreement”) outline the booking and cancellation policy for music lessons offered by The Noise Factory (hereinafter referred to as “The Noise Factory” or “We”) to the student (hereinafter referred to as the “Student” or “You”). By engaging in music lessons with us, you agree to abide by the terms and conditions outlined herein.
2. Payment
2.1 Upfront Payment: The full length of the term is paid for at the commencement of the invoiced term. This ensures that the Student’s spot is reserved for the entire term. Understandably If you need to discuss this further, please contact info@thenoisefactory.com.au.
3. Lesson Cancellation

3.1 Cancellation by the Student: In the event that the Student needs to cancel a scheduled music lesson, a minimum notice period of 24 hours prior to the lesson time is appreciated. Failure to provide adequate notice may result in the forfeiture of the lesson fee. Unforeseen circumstances and illness will be taken into consideration.

3.2 Prolonged Absences: In the event of excessive and prolonged absences due to illness, The Noise Factory and the Student (or their parent/guardian) may enter into discussions to determine a fair and reasonable solution, or a temporary suspension of lessons until the Student is well enough to continue.

3.3 Lesson Rescheduling: Students have the option to request a rescheduled lesson, given that they adhere to the minimum notice period as outlined in clause 3.1. The availability of rescheduled lessons is contingent upon The Noise Factory’s schedule. The final decision regarding this policy rests with The Noise Factory.

3.4 Failure to Attend or Late Notice: Failure to show up for a lesson or providing late notice will result in the full lesson fee being charged.

3.5 Group (Band) Sessions: There will be no refunds or credits for missed group sessions. The program will continue with or without the Student’s attendance.

4. Cancellation by The Noise Factory

4.1 Emergency Cancellation: In case of unforeseen emergencies, The Noise Factory may need to cancel a lesson. In such cases, The Noise Factory will make every effort to reschedule the lesson at a mutually convenient time or provide a credit or refund for the canceled lesson.

4.2 Discretionary Cancellation: The Noise Factory reserves the right to cancel lessons if the Student’s behaviour is disruptive, disrespectful, or unsafe. In such cases, the Student may not be entitled to a refund for the canceled lesson.

5. Refunds

5.1 Refund Policy: Refunds will be issued at the discretion of The Noise Factory and will be considered on a case-by-case basis, primarily in cases where The Noise Factory is unable to fulfil their obligations due to unforeseen circumstances.

6. Lesson Credits

6.1 Lesson Credits: The Noise Factory will not be issuing credits for cancelled lessons by the Student. Make-up lessons will be offered within the term or soon thereafter. Make-up lessons not claimed in a timely manner will be forfeited.

7. Termination of Lessons

7.1 Termination by the Student: If the Student wishes to terminate lessons, they are required to provide written notice. As lesson spots are reserved for the term, refunds or credits will be forfeited or otherwise agreed upon.

7.2 Termination by The Noise Factory: The Noise Factory reserves the right to terminate lessons with the Student for reasons including but not limited to non-payment, chronic cancellations, or disruptive behaviour. In such cases, a discussion may be had between both parties.

8. Automatic Renewal

8.1 Automatic Renewal Policy: Lessons will automatically roll over to the next term unless a written cancellation notice is provided by the Student at the end of the term, before the start of the new term. Students will be invoiced accordingly for the new term.

9. Changes to the Booking and Cancellation Policy

9.1 Policy Amendments: The Noise Factory reserves the right to make changes to this Booking and Cancellation Policy. Any changes will be communicated to the Student in advance, and the Student’s continued engagement in lessons will be considered acceptance of the updated policy.
